New York, NY: A class action lawsuit alleging Steve Madden Ltd, sent unsolicited text messages to consumers advertising the company' fashion products and promotional events has reached a potential $10 million settlement. The lawsuit, Ellison v. Steven Madden, Ltd, claims that because these text messages were unsolicited, the company violated the Telephone Consumer Protection Act (TCPA).
The proposed settlement agreement also makes possible the removal of consumer cell phone numbers from any list or database on which they currently appear, to which text messages could be sent promoting Steve Madden Ltd, products or events.
A fairness hearing is scheduled for February 25, 2013, and if approved, class members may be eligible to receive up to $150 if they submit a valid Claim Form by April 11, 2013. Class Members include all US persons who received a text message promoting Steve Madden products and/or events from the "short codes"91919 or 623336 between July 2010 and September 25, 2012.
