Atlanta, GA: A class action lawsuit has been filed against Defendant Portfolio Recovery Associates, LLC ("PRA") in the United States District Court for the Middle District of Florida on behalf of all persons in the State of Florida who, since February 18, 2011, received a non-emergency telephone call from PRA to a cellular telephone through the use of an automatic telephone dialing system or an artificial or prerecorded voice and who did not provide prior express consent for such calls during the transaction that resulted in the debt owed.
According to the Complaint, PRA violated the Telephone Consumer Protection Act ("TCPA") by using automatic dialing systems and/or an artificial or prerecorded voice to contact cell phone users about purported debts without their prior consent. As described in the Complaint, Ms. Harvey, the named plaintiff in the action, was repeatedly contacted since February 18, 2011 on her cell phone about a purported credit card debt. The plaintiff never consented to those calls, nor did she provide PRA with her telephone number.
Under the TCPA, PRA could be ordered to pay attorneys' fees, litigation expenses and costs of the lawsuit, and statutory damages of $500 for each negligent violation, and/or $1,500 for each knowing and/or willing violation. According to the Complaint, the potential Class Members are estimated to number in the tens of thousands. Additionally, the complaint alleges collective damages exceeding five million dollars ($5,000,000).

Paid the account in full to Portfolio Recovery in 2014 and they still reported as a charge off on my credit report. When I spoke with a representative they advised me that they entered the wrong ss# in there system. With this charge off on my credit report I've paid high interest rate on a auto loan and denied a home loan.

They called my neighbors! Consistently called my house for hours. I had my anxiety fuming from the relentless bullying. They told me I owed money and never once said to what creditor? They continued to request for my bank information. I can't even talk about this. Purposefully would call, back when I hung up. Kept redialing, harrassing as if this was a joke. To me these people are con-scam artists, who do not care who they emotionally burn.

I have been harassed by Portfolio Recovery since 2012. The first correspondence I received was a Sheriff showing up at my front door step with a summons for court in front of my 3 children. Imagine my surprise as I have never been in trouble with the law. The "debt" in question pertained to a dental bill that was never fulfilled. I was traveling at the time and did not have the time to keep appointments at which time I told the dental company in question that I could not make the appointments and to please remove me from their schedule as well as disregard the "debt" as I had not had any work completed. I went round for round over the course of 6 months to have this cleared and removed from my credit which in turn they refused to do so stating their attorney's completed an "investigation" stating I had received the work. After numerous disputes the contact ceased, namely because I made them aware I knew they were in a class action suit for harassment and wrongful practices. On Sept. of 2015 my credit report showed this had been satisfied and was not contacted from this point forward. Fast forward to July 2017 as my family of 6 was in process of buying a house, it reared it's head again. Portfolio Recovery stated to my loan officer that all they needed was for me to sign a release form to notify the clerks it was satisfied. At this time they then refused to file this paperwork and stated in fact it had not been cleared and that I still owed this money and would not back done. This left me with no choice but to pay for a bill I had not received work for and requested proper paperwork to be sent to my loan officer to show it was fulfilled which they still refused to provide. My family of 6 is now looking to be displaced from our home due to the fact that they have continually back tracked and not provided or done what they need to do. This business should be shut down by the Federal Government and fined severely for their practices.

They have been calling me for years about a debt that was cleared up years ago. They call my land line and my cell phone daily so many times its harassment . Just the other day I answered my phone from a private phonenumber. and the lady was rude and forceful yelling at me wanting to verify my address and stated They have Court papers to send to me. First of all, I too never gave them permission to contact me via my cell phone.Secondly, I also rec'd a fake court paper that says my bank account is being levy'd. Its a Joke. Isn't that illegal to falsify legal documents, This company is extremely unprofessional

I Received white post card back in 2016 about suit against Portfolio Recovery concerning automatic calling dialing systems was told to call and give number on claim card was told that this was all I had to do but was not been in contact about settlement pay out put my e mail in they said there was not there can not reach anyone at phone number all so sent a letter no reply would like to know how or what was settled I was called at least 1o times a day for years they even changed there numbers to get me to answer phone it been settle I heard and they are calling me again like nothing happen thank you I hope you can figure this out no answer from anyone in litigation

I received a claim check from them today for $12.58. I assume this is from the class action lawsuit. The check and attachment do not mention the settlement.

I found this to those that are still wondering about the payout date.
On January 25, 2017 the Court entered a written order, approving the Settlement.
Payments to class members will be made from the settlement fund on or before March 27, 2017, unless an objector files an appeal of the Court's order approving the settlement.
If there is an appeal filed by any objector to the settlement, then the distribution of settlement checks to class members will be delayed until the appeal is resolved. This could take approximately two years.
The settlement administrator received approximately 350,000 claims. Based on the information we have now (and assuming the Court grants all the fees and expenses sought), each claim should receive approximately twenty-eight dollars ($28).

Well this class action suit must not phase portfolio because they called me today from phone number 323-316-2429 and I have a new cell number what the hell. The bill is a credit card for orchard bank I told them I never had this card and it has never been on my credit report. This is the same thing I said to them when they called my old number. please tell me what I have to do to get it a crossed to them and get them to stop calling me and hunting me down. I feel that they are violating my privacy and or stocking me. I guess I have to change my number again.

They are still calling and writing me over a debt that was not mine and is over 8 yrs old. I disputed in writing and asked them not to contact me further. They sent me another notice today. Please make them stop harassing me.

I found this after some hard searching.
Basically states a check will not come for at least another 30 days and may take 2-3 months total. According to the article expect a $479 payment and if you paid a debt through them expect another $1029. I'm not sure if these numbers are accurate but it's the only thing I could find on the class action

I also received the card and registered for the class action. I have been checking the site every day since Dec 5th as instructed and there is no update. I called the # listed to get an update and there is none. I have read online that this is a scam. I hope not.

I have been called and contacted by mail by PRA aka Portfolio Recovery. I filed bankruptcy 2012 and according to my lawyers my car was paid afterwards I was contacted by PRA for payment. I would like to know where my title to my car is?

I was contacted many times on my cell phone by Portfolio. They called early in the morning (before 8 a.m(. and late at night (ater 9 p.m.).. They threatened me with legal action and constantly insisted that I give them my banking information so that could deduct what they said I owed from my bank account. Yet they refused to tell me who I owed the debt to. I received the post card regarding the class action suit and have replied.
