New York, NY: The gum company Wm Wrigley Jr. Co has reached a $6 million settlement in a class action lawsuit brought by consumers who alleged the company used misleading advertising to sell its Eclipse brand of gum. Specifically, the suit claimed that the gum was scientifically proven to kill germs that cause bad breath, and this enabled Wrigley to charge a premium price for Eclipse.
Under the terms of the settlement, which was filed in Florida on Friday, class members could receive $10 per person. The lead plaintiff will receive $10,000 and the lawyers $2 million. Additionally, Wrigley has agreed to remove claims on the gum's labeling that suggest that it kills germs.
The settlement is pending approval by a judge.
