New York, California, and six other states brought a class action lawsuit to a New York Federal court against several major utilities companies for carbon dioxide emissions. The lawsuit was dismissed by the federal judge on grounds that the issue was of a political nature and could not be resolved in the judiciary system. The defendants, American Electric Power Co. Inc., Southern Co., Xcel Energy Inc., Cinergy Corp., and the Tennessee Valley Authority public power system, are the five largest contributors to carbon dioxide emissions in the U.S. (Sep-16-05)
