Los Angeles, CA: (Jul-09-07) A class action lawsuit was filed against Nutramerica Corp., the marketer and distributor of TrimSpa X32 dietary supplement pills, by Belkis LaRosa in the Los Angeles County Superior Court. TrimSpa Corporation, Goen Technologies Corporation, and Alex Goen were also named as the defendants. The suit claimed that the labeling and advertising for TRIMSPA X32 were false and misleading. The plaintiffs' announced April 1, 2003 through October 31, 2006 to be the class period.
In a settlement reached, the defendants, who did not admit any liability or wrongdoing, agreed to provide cash payment, a free bottle of multivitamins, and a transferable discount coupon for each bottle of TRIMSPA X32 purchased during the class period. Each valid claim will be settled with a $1.00 for each bottle of TrimSpa X32 purchased; one free bottle of Winfuel multivitamin or MultiSpa Men's or MultiSpa Women's multivitamin, and a $5.00 coupon which is transferable and redeemable for a $5.00 discount on a 90-count bottle of any of the defendants' products. Further, as part of the settlement, plaintiff's counsel will apply for attorneys' fees and expenses in an amount not to exceed $3,428,000.
