Target Settles with New Jersey Over Selling 'Old Drugs' and Infant Formula

Newark, NJ: Retailing giant Target has agreed a settlement with the New Jersey Attorney General, Anne Milgram, resolving allegations that Target was selling prescription drugs and infant formula past their expiration dates.

The amount of the settlement is $375,000. Terms and conditions of the settlement are numerous, and include the creation of a Group Pricing Compliance Specialist who will monitor compliance with Target's policies as well as with the settlement terms as to price accuracy. And Target has agreed not to sell or offer for sale any non-prescription drugs or infant formula that are past their expiration dates. Further, they will check the expiration dates on these products before displaying them for sale.

The lawsuit, filed in September 2008, resulted from inspections by the Division of Consumer Affair's Office of Consumer Protection and the Office of Weights and Measures in 21 of the 40 stores Target has in New Jersey.
