Los Angeles - A class action lawsuit was filed against the popular talk show host alleging deceptive and untruthful advertising of his Shape Up! weight loss products. The suit alleged false advertising by claiming the supplements cause weight loss by promoting metabolism of fat and reducing carbohydrate cravings and appetite swings. The suit was filed on behalf of consumers who purchased the products, which are advertised being effective for all body types and can cost consumers $60 a month. Under the terms of the settlement agreement, a settlement fluid recovery fund will be established consisting of $6.0 million of Nutrilite® Daily Multivitamin/Multimineral, 6-month supply, and $4.5 million in cash.
