Citizens of South Annville sought an injunction for the township's plan to borrow more than $5.5 million to pay for its sewer project. The amount exceeds 250% of the township's borrowing base. The case alleged the excessive amount was prohibited by state law and therefore illegal. County Judge Samuel Kline threw out a class action because the plaintiff's lawyer failed to properly serve court papers to the township, mistakenly sued the wrong governmental entity, and filed the lawsuit in the wrong court.
