San Diego, CA: A class action lawsuit was filed against the internet based florist regarding the freshness of their flowers. The lawsuit was filed in Los Angeles Superior Court in October 2005 and alleged that ProFlowers uses middlemen, distribution centers and warehouses to store its products before they are shipped to customers. The company claims to have the freshest flowers anywhere because it bypasses middlemen and ships directly from the fields, but consumers complained of wilted and freezer burned flowers being delivered. Provide Commerce, which operates ProFlowers, did not admit any wrongdoing, but has proposed a class action settlement that will make customers eligible for a $10 store credit. The online florist will pay up to $250,000 in attorney fees and give $10 credits to millions of customers. (Nov-06-06)
