Peoples Benefit Services Inc. allegedly violated the do-not-call provisions of the Federal Trade Commission's (FTC) Telemarketing Sales Rule. The seller of discount health and prescription drug cards, dental discount cards, health-related discount cards and an online medical referral service to consumers, was accused of authorizing its telemarketer, Malvern Marketing, dba Phase One Marketing, to call consumers on the national DNC registry on the basis of an established business relationship with Peoples or its corporate affiliates. As well, the FTC alleged that the defendants violated the TSR by continuing to call tens of thousands of consumers who had asked to be placed on their entity-specific do-not-call lists. (Jun-16-06)

I am registered on the National Do Not Call list, but I have proof that someone called me today. The number is (754) 212-1024 from Florida advertising to me. Can I sue them?
