A lawsuit was filed and was seeking class action status against the retail chain store. The case was filed on behalf of current and former Wal-Mart employees in the state of New Jersey who claimed they worked through meal and rest breaks. A state appeals court upheld a trial judge's refusal to certify the lawsuit a class action. Appellate Division Judge Doro thea Wefing noted the lawsuit was not appropriate as a class action because individual factual determinations would have to be made of the circumstances under which a particular employee missed a break or worked off the clock.
