Long Island Power Authority Class Action Thrown Out



Mineola - Fed up customers tried to file a class action lawsuit against the power company for unjust enrichment, deceptive trade practices and breach of contract. The lawsuit claimed Long Island Power Authority (LIPA) pushed non-fuel fees into its fuel-adjustment surcharges and avoided a rule mandating that the Public Service Commission review rate hikes over 2.5 percent. LIPA noted the increased surcharges were necessary to cover increased fuel costs. A state Supreme Court judge threw out the class action lawsuit.
