Taylor, PA: (Feb-5-08) A class action lawsuit was brought against the Alliance Sanitary Landfill by more than 700 people in Old Forge, Taylor and Ransom, alleging that noise, dust and odor from the landfill caused a nuisance for residents and lowered property values. The suit was filed by two couples, William and Cynthia Toman, of Old Forge, and Joseph and Maureen Labrosky, of Taylor, against Alliance and owner Waste Management Inc. in 2003.
Following several hearings where residents who lived within three-quarters of a mile of the landfill between Jan. 1, 2001, and Dec. 31, 2003, were allowed to voice objections to the proposal, Judge Robert Mazzoni approved a settlement in December 2007, resolving the class action lawsuit. Under the terms of the deal, more than 700 people in Old Forge, Taylor and Ransom have received at least $1,300 from the $3 million settlement. All together, 1,225 people were eligible for a chunk of the settlement, and about 766 people opted in, according to court records. [
