La Jolla, CA: (Aug-17-07) A class action lawsuit was filed against Lamps Plus, Inc. in San Diego County Superior Court, by plaintiffs who alleged that that the company violated the California Civil Code Section 1747.08. The suit claimed Lamps Plus asked its customers to provide personal identification information in connection with a credit card transaction, which was in violation of California Civil Code. Personal identification information is information concerning the cardholder other than information set forth on the card, such as address and telephone number. The class involves anyone who was part of such a transaction between November 9, 2002 and July 17, 2007.
In a settlement reached, Lamps Plus agreed to give a $15.00 voucher to each class member. Each $15.00 voucher is not transferable, not stackable and can be used to purchase a Lamps Plus product. The voucher will expire one year from the date of issuance. Further, the settlement enjoins Lamps Plus from further requests of any Personal Identification Information during a credit card transaction, other than a zip code, and from the use of pre-printed forms containing spaces for the entry of any personal identification information during a credit card transaction.
