Employees tried to file a class action lawsuit against the company alleging age discrimination. They were awarded a $6 million settlement, but Knolls appealed the judgment. Age is not protected by Title VII federal and New York state anti-discrimination laws. Age has relevance to an individual's capacity to engage in certain types of employment, and as a result, certain employment criteria that are routinely used may be reasonable despite their adverse impact on older workers as a group. The U.S. Court of Appeals for the Second Circuit has dismissed the case. (Aug-17-06)
