Nearly 150,000 current and former Kmart employees suffered a combined loss of $100 million in their 401(k) plans when the retail chain store went bankrupt in 2002. The class includes all participants and beneficiaries of the plan from March 15, 1999, through March 6, 2003. They filed a class action lawsuit against their employer alleging Kmart forced workers to maintain the company match portion of their 401(k) in Kmart stock until they reached age 55. Kmart has agreed to an $11.75 million settlement. (Nov-30-05)

I worked for Kmart #4389 Texas from 1980 to 2002 I quit to go to another job and I never got my 401K I called the Sears Company they told me it was Millennial Trust Company had it I called it wasn’t there then they told me it was Prudencial it’s not there. My mother had a 401k with Kmart when she passed away in 2004 while working there for over 22 years. My mother was never married and I am her only child. Kmart kept my moms 401k because they said only a spouse can collect an employee’s 401k. Can they really just keep all of my mothers money like that? Or is it to late to do anything about it?

I also work for Kmart in Billerica Mass.and Springhill Florida. mid 1990's and earlier 2000's. The Kmart in Springhill Florida closed so even to find records are going to be hard. I do believe I paid something into the 401k but during a move records were lost.
