Pheonix, AZ: A settlement has been reached between Iovate Health Sciences U.S.A. Inc. ("Iovate" or "Defendant"), makers of Hydroxycut, and Daniel Garcia and Kevin Branca ("Class Representatives" or "Plaintiffs"), individually and on behalf of the Settlement Class.
The settlement resolves a consumer fraud class action lawsuit that alleged Iovate made false and misleading statements in its labeling and advertising regarding the effectiveness of Hydroxycut dietary supplement products.
Iovate denies the allegations and is settling to avoid the expense and distraction of litigation. The settlement does not mean Iovate did anything wrong, and the Court has not decided that Iovate did anything wrong.
The settlement provides cash payments based on the amount of Hydroxycut products purchased.
