In the fall of 2005, 75% of homes in Broward and Miami-Dade were darkened by Katrina and 98% lost power from Wilma. Customers tried to file a class action against the utility alleging gross negligence in maintaining its system. The lawsuit claimed the utility breached its contract with customers to provide continuous electricity and to ensure that power outages do not occur. A Circuit Court Judge has dismissed the case with prejudice, meaning it can not be re-filed. (Feb-09-06)
