A $630,000 settlement has been granted preliminary approval in the class action lawsuit filed against Educators Mutual Life Insurance Company. The case was filed on behalf of approximately 3,000 policyholders who were challenging the company's reduction of benefit payments for anesthesia services. Under the terms of settlement, the class would include, "All persons whose anesthesia bills were paid in part (but not in full) under a policy of medical insurance with Educators at any time since September 1, 1998 due to the "reasonable and customary charge" provision of the Educators' policy. Excluded from the class are insureds of PPO policies whose anesthesia services were provided by an in-panel provider." Any claims must be filed on or before August 8, 2003.
