Seven shareholders tried to file a class action lawsuit against the companies for allegedly violating the Investment Company Act of 1940, the Investment Advisers Act of 1940, New York law and the common law, and breaching fiduciary duties to the Funds and their shareholders. They filed the suit in the United States District Court for the Southern District of New York but the Court issued an Opinion and Order dismissing the Lawsuit in its entirety and rejecting the plaintiffs' request to amend their complaint.
