Chicago, Il: A settlement in the defective gasoline class action lawsuit pending against BP, has been finalized, with eligible class members able to receive reimbursement for gasoline purchased, replacement costs of the gasoline purchased, and repair costs.
The class action, entitled Price, et al. v. BP Products North America Inc., Case No. 12-cv-06799, U.S. District Court, Northern District of Illinois, alleged BP sold defective gasoline in Illinois, Indiana, Wisconsin and Ohio. BP issued a recall of of some 4.7 million gallons of tainted gasoline in those states, which prompted the lawsuit.
Eligible class members include all owners or lessees of vehicles or other items with gasoline powered engines that received gasoline purchased or had it put in their engines at qualifying retail outlets in Illinois, Indiana, Wisconsin or Ohio from August 13, 2012, through September 7, 2012, and who:
1) Experienced engine performance or drivability issues resulting from the use of the affected gasoline but did not undertake repairs by that date; or
(2) Undertook repairs resulting from the use of the tainted gasoline.
