Overtime Pay Due



Minneapolis, MN: (May-22-08) A class action lawsuit was brought against ABRA Auto Body and Glass, by two former ABRA employees, alleging that the company required certain employees to work overtime without pay, misclassifying them as a managerial class, which according to federal wage laws, is exempt from overtime pay. The employees who sued said that the company targeted customer service managers (CSMs) and customer service representatives (CSRs) for the overtime work.

Sources stated that in a recent announcement, the US District Court for the District of Minnesota has given preliminary approval for a settlement agreement, which will have the company pay $1 million to the class members. In order to calculate the allocation of the settlement fund, plaintiffs in the class will calculate the number of months each worked at ABRA between Jul. 1, 2004, and Apr. 30, 2008. Additionally, the class requested that the two named plaintiffs, who originally filed the suit, Thomas Hale and Justin Schreckenstein, receive payments of $7,500 each.
