$3.2M Settlement Reached In Life Alert Unpaid Wages Class Action Lawsuit

Santa Clara, CA: A $3.2 million settlement of a Fair Labor Standards Act class action lawsuit has been granted preliminary court approval.

According to the complaint, workers for Life Alert, a company that makes emergency response devices for senior citizens, were misclassified as independent contractors, resulting in illegal failure to pay minimum and overtime wages.

The settlement includes three classes: those who worked in New York as independent contractors from Sept. 15, 2008, through March 31, 2016; those who worked in Florida as independent contractors from Sept. 15, 2009, through March 31, 2016; and those who joined the FLSA collective action before Oct. 1, 2015, within three years of their employment.

According to the settlement terms, each class member will receive an award based on the amount of time they worked. The New York class consists of 781 members who will receive an average award of $2,136 each. The Florida class has 957 members each of whom will receive an average of $1,711. The FLSA class has 372 members who will receive an average of $1,499 each.

Filed in 2014, by Margaret McGreevy, the complaint was amended in June 2015 to add two other named plaintiffs and Florida state law claims. Several months later in October 2015, the parties had a mediation session and negotiated a final settlement.

As per the terms of the settlement, McGreevy will receive a class representative service award of $7,500, and the other two named plaintiffs will receive $5,000 each.

Any uncashed checks by class members, after 180 days, will be distributed to MFY Legal Services and Bet Tzedek, which provide free legal assistance.

The case is McGreevy v. Life Alert Emergency Response Inc., case number 1:14-cv-07457, in the U.S. District Court for the Southern District of New York.

I'm about to contact MY attorney. I've been waiting two years to get my money that life alert scammed me out of.

Let's start a new lawsuit against these lawyers who clearly have no idea what they're doing!

Anyone hear anything? I'm thinking of contacting my attorney. The justice system and these ambulance chasers need to figure this out. I want the money that's owed to me. Life alert ripped me off.

Contact attorneys. Hoping there are no more appeals. People need to accept the payout and move on so we can get out compensation!

This was a response I received last month.

Final approvals of the settlement have been issued by the respective Courts in McGreevy and Barragan, and if no appeals are filed in either case, we anticipate checks will be mailed to class members no sooner than early June.

When can I realistic receive ,my money from the Life Alert law suit?

If I worked many more weeks than some others in NYC, will I get significantly more money than colleagues who worked less hours than me??
