Chicago, IL: A $1.53 million settlement reached in an unfair business practices lawsuit against Thiems Construction and Fox Creek II Land Trust involving sediment runoff into an Edwardsville couple's four acre lake will stand.
On September 30th, the Illinois Supreme Court denied the defendants' petition to appeal a Fifth District Appellate Court decision that upheld a verdict awarding Fred and Jaunita Steinkuehler $765,000 in compensatory damages against both defendants and $765,000 in punitive damages against Thiems.
The lawsuit was brought by the Steinkuehlers in 2010 alleging that an excessive amount of sediment from Fox Creek II, an adjacent planned subdivision, was being deposited in their lake.
According to the complaint, both during and following the excavation work, the defendants failed to take adequate steps to prevent the excessive runoff of muddy storm water. This negligence resulted in the accumulation of greater than normal amounts of silt.
The lawsuit cited trespass and nuisance. According to the complaint, the main issues, apart from liability, were: (1) how much of the accumulated silt was the defendants' responsibility; (2) how the silt would be removed from the lake; (3) how much it would cost; (4) whether punitive damages were appropriate; and (5) whether Thiems had violated city ordinance.

Plus paying higher deposits because of the being late. The Housing Authority people in Utah know this is unlawful practices. But there not to try and stop it there only the government housing authority of the state of Utah. The more I fight it and bring to attention it's wrong. The more hate mail I receive. The police,Schools,Hospitals,including peditritions my children have had for entire life.
