A lawsuit has been filed and is seeking class action status against Microsoft alleging the Xbox 360 video game system scratches game disks. The lawsuit was filed in US District Court for the Southern District in Fort Lauderdale, FL and claims the games consoles are negligently designed and manufactured.
The case claims Microsoft has received thousands of scratch complaints, but has failed to replace all the games and often charges a $20 replacement fee. One investigation found that one in nine Xbox consoles scratched disks after only five hours of play. Some gamers speculate that moving the console between vertical and horizontal positions while a disc is spinning inside could cause the scratching. Microsoft warns against such actions with a sticker placed on new consoles.
