A class action lawsuit has been filed against the Californian nursing care facility operator for allegedly providing substandard care and neglecting the rights of its senior residents. The lawsuit was filed in Orange County Superior Court on behalf of residents who lived in one of the company's 15 California facilities between November 2003 and October 2007.
The complaint alleges Windsor promotes itself to people who are elderly and to their families by claiming to provide superior and attentive care. Windsor's advertisements, web sites, brochures and other promotional materials claims the facilities provide skilled nursing care services of a particular standard and quality which will meet the needs of prospective and current residents. However, the suit claims Windsor Healthcare Management in Salinas received 83 notices of deficiencies between June 2004 and August, 2007. The lawsuit alleges substandard care and neglect of residents' rights was a corporate-wide strategy and policy mandated by its parent corporations and officers.
