Santa Clara, CA: Williams-Sonoma is facing a privacy violations lawsuit filed by a Massachusetts woman who alleges the retailer unlawfully accesses customers' personal information.
Filed by plaintiff Judith Monteferrante, individually and for all others similarly situated, the lawsuit asserts violations of the Massachusetts Unfair Trade Practices Act and unjust enrichment.
Specifically, the suit states that Williams-Sonoma collected ZIP codes belonging to its customers, when customers made purchases with credit cards. The complaint states Williams-Sonoma collected its customers' ZIP codes for its own business purposes, using the ZIP code and name to identify the customer's address and/or telephone number through commercially available databases.
According to the complaint, the defendant then uses the information it has collected for intrusive marketing purposes, such as sending junk mail to customers' homes without their permission, and selling customer information to third parties.
Monteferrante and others in the class are represented by attorneys D. Greg Blankinship of Finkelstein Blankinship Frei-Pearson & Garber in White Plains, New York, and Kim E. Richman of The Richman Law Group in Brooklyn, New York. The lawsuit is US District Court for the District of Massachusetts Case number 1:16-CV-10578-MLW.
