On March 10, 2008 WellPoint, Inc. ("WellPoint" or the "Company")(NYSE: WLP) cut its earnings outlook for fiscal 2008. On this news, the price of WellPoint's common stock dropped 28.3% to close at $47.26 per share. WellPoint and other administrators of the WellPoint 401 (k) Retirement Savings Plan (the "Plan") may have breached their ERISA-mandated fiduciary duties of loyalty and prudence to participants and beneficiaries of the Plan. A breach may have occurred if the fiduciaries failed to manage the assets of the Plan prudently and loyally by investing the assets in Company stock when it was no longer a prudent investment for participants' retirement savings.
