A class action complaint alleges that the Wachovia Bank improperly used assets in clients' fiduciary accounts to buy shares of various captive Evergreen Funds rather than other mutual funds that were better managed and had lower expenses. The suit also claims that the bank incurred no expenses in sweeping fiduciary accounts and therefore its sweep fees to clients were not warranted.
