Urban Active Faces Proposed Fraud Class Action

Lexington, KY: Urban Fitness is facing a proposed class action lawsuit over allegations that the fitness centers violate Ohio consumer protection laws and engage in fraud and unfair and deceptive business practices.

Specifically, the suit, filed by Amber Gascho, alleges that the company: failed to provide consumers with a copy of personal-training contracts at they time they signed them; failed to tell consumers of their rights to cancel the contract within three days; failed to provide consumers with notice of cancellation forms; misrepresented the terms of contract cancellation; and didn't honor consumers' notices of cancellation.

Gascho claims that when she signed her contract in July 2010 she was not told the contract was a year-long commitment and was not told the full cost of the contract. She further alleges that she was told that for a $10 administrative fee she could cancel the contract at any time. However, she ws not provided with a copy of the contract nor any additional oral or written information about the cancelation policy.

Several weeks later Gascho tried to cancel the contract the suit claims, however, she was shown the contract and told that she would have to pay $250 or 15 percent of the balance owed as a cancellation fee. Urban Active continued to charge her account until she got her bank to cancel the payments, according to the suit.
