A lawsuit alleges that UPS failed and refused to pay it maintenance mechanics and other employees' lawful and required overtime rate for hours worked beyond 40 hours per week and therefore violated the Fair Labor Standards Act (FLSA), the Illinois Minimum Wage Law and the Illinois Wage Payment and Collection Act.
The lawsuit states that uncompensated work time began prior to scheduled start and after the scheduled end of shifts. Employees spent time working in proceeding through security and metal detection devices, walking and traveling to and from locker rooms to change into uniforms and charging their electronically powered work carts. The lawsuit claims that UPS knew its employees worked more than 40 hours per week to include all work activities. According to the FLSA, employees of UPS worked overtime for the past five years.
