Santa Clara, CA: An unpaid wages and overtime class action lawsuit has been filed against iQor by its workers who allege the timekeeping system that iQor uses, TimeQey, systematically underpays them.
Specifically, the lawsuit asserts that workers employed as contact center agents, customer care agents, collections agents, new business agents, student loan agents, and sales agents (collectively, CCAs) are not paid for time when their computers are idle for two minutes or more, regardless of whether CCAs performed compensable work or should otherwise be paid for the time. In addition, the Complaint alleges iQor failed to compensate CCAs for the full duration of their rest breaks.
Potentially eligible plaintiffs may include anyone who was scheduled to work for iQor as a CCA for more than 40 hours in a week at least once in the past three years, at any location in the United States.
The Complaint seeks to recover unpaid wages at CCAs' regular pay rate, known as straight-time wages, unpaid overtime wages, and other damages and penalties.
Plaintiffs are represented by Nichols Kaster and Douglas L. Micko and Vildan Teske of Teske, Micko, Katz, Kitzer & Rochel, PLLP. The case is Shoots v. iQor Holdings US Inc. Court File No. 0:15-cv-00563-SRN-SER

Hello, I am reaching out because I am a victim of being under paid while working with iQor in 2010, I remember receiving the job November 2010 and resigning July 2011 due to not being paid accurate. The systems would shut down, and at the time my supervisor was Joelle patillo and she advised me that the hours on my checks were correct, the company does not allow them to pay employees downtime due to system issues. I even remember asking if I can leave if I'm not getting paid and I was advised it'll count against me. At the time I felt confused, it was my first real job I was pregnant with my first child (which I miscarried) and decided to quit for a better job. I worked 80+ hours and received a work check for $300 ($280) which blew me over the edge.

I have been a ccr for the dtv account for many years but i have been working for iqor for about 6 months and I have to say it is about to put my on medication and the management is of no help half our tools do not work and when you've been there a long time you know work around to get your job done and to get customer satisfaction but when you do this you get write ups and threatened to be written up and fired because you went out of the system to treat your customers like a human and not a number like one great example is when the genie remote does not control a Samsung TV we are told to replace the remote at a cost of $15 dollars charged to the customer even though they have the protection plan that covers that and if we give the remote covered under the plan we get talked to by our supervisor on why we did not follow our tools but nothing official but forget to click a link in the tool and falsify info you get fired but the tool leads to unfriendly praces to the customer like repeating steps over and over in an infinty loop and causing customer sto get mad and hang up and you get a warning and that will lead to termination and other threats against your job! and if a customer hapens to have bad cell service in area and the call dropps you call them back you are idle and there for do not get paid and get a call back against your stats! when I try to argue my point I am told by my supervisor and the management staff that i was a number and expendable! As for the over time pay there was a gentleman that was shorted 40 some hours of over time pay( I don't know if that was straiten out at time of post ) I have been shorted an hour here and there but it always gets made up when i mention it but why do i have to do payrolls job?with i was not given access to my pay roll or timeqey so i sit down with my direct supervisor and go over my time card and we are told that we can have pictures on our desk but only if they fit a photo frame provided by company

IQOR took over our center too! Best and nicest way to put it, it has been a disaster. We are all miserable, and things keep getting worse. We are constantly not getting paid for something, being denied any of our PTO time, insurance benefits have went up in costs, we are threatened of being fired on a daily basis. I miss asurion more than I ever realized I would. I used to enjoy my job, now I dread it everyday.

The 75 dollar Gift Cards aren't even legal. I normally don't comment on my employer but since we aren't asurion anymore I don't care if I piss anyone off Lol. It would be one thing if it was just the gift cards, or just the non payment of after call, or just not having access to half of our systems and still being held to the same standards as if we did. Maybe if it was just the fact that after 2 minutes of idle we don't get paid, or just the fact that they are illegally not paying break overages, or that management doesn't give a half of a damn if we are getting screwed. Or the fact that they are considering these illegal gift cards as a payroll advance, which one; an employee in PA has to request, two, has to be for an open pay period, or a pay period that hasn't started yet, not one we already worked. And it can not be taxed after payment is given and two is illegal because you can't use it to collect cash. So they are totally screwing us over and completely ignoring all of the laws. Also I have colon failure and have an intermittent leave for it. Well that's gone now, and I called the company and they told me iqor told them we aren't eligible for any type of leaves because we haven't worked for them for a year. This company is by far the worst company I have ever worked for and I have contacted the labor relations board and have been told how illegal this is. If anyone needs the Pennsylvania labor relations number message me on facebook!

I would love to hear updates on this as well. I'm in the same boat IQOR just took over my call center. Since then it has been the worst work experience i have ever had. They threaten us with 2 minutes idle for anything will be logged out and not paid for. Say I'm on a call and my computer times out and the screen saver comes on, they say we are idle and not paid. Any acw (after work time) not paid. So if a customer hangs up we are instantly in acw and not being paid. We have no E-mails or Instant messenger. We barely have any tools to do our job its a struggle. They haven't provided us with a way to access or time cards either.

Iqor took over our company as of December 1st.. Two weeks ago I and all my fellow employees were promised that there were #2 $75.00 gift cards that were going to be handed out to us to cover some of our wages for the 1st and 2nd of December pay. We never received these cards that were already in the building! Really! What do we do?

Would love to hear updates on the lawsuit, our employer asurion sold our center to iqor and we have already been threatened with non pay if idle for 2 minutes and they qont provide us with a timekeeping system to access our time info and we also have no access to iur own schedules or tume off requests, im pretty sure im out of luck on my paid time off hours aside from my current unpaid days from the transition.
If we could get updates that would be great
