New York, NY: Sirius XM Radio Inc. is facing an unpaid intern class action lawsuit, filed by Melissa Tierney, a former intern for The Howard Stern Show. Filed in federal court, Tierney alleges in the lawsuit that the satellite radio company is in violation of the Fair Labor Standards Act (FLSA) and New York labor law because it had its interns work long hours with no monetary compensation.
According to the complaint, "members of the putative class were regularly required to perform work for [Sirius XM], without receiving minimum and overtime wages as required by applicable federal and state law."
Tierney, a New York resident, worked as an intern at Sirius XM from August 2011 through December 2011. She alleges that as an intern, she performed work necessary to Sirius XM' operations but did not receive any academic or vocational training, and wasn't compensated for her work.
The lawsuit is Tierney v. Sirius XM Radio Inc., case number 1:14-cv-02926, in the U.S. District Court for the Southern District of New York, and class members would include all unpaid Sirius XM interns. Plaintiffs are represented by Lloyd R. Ambinder, LaDonna M. Lusher and Suzanne B. Leeds of Virginia & Ambinder LLP and Jeffrey K. Brown, Michael A. Tompkins and Daniel Markowitz of Leeds Brown Law PC.
The proposed class is seeking unpaid wages and interest on that income.
