Class action status has been granted to two classes in the lawsuit filed against Tyson Foods, Inc., Simmons Foods, Inc., and Peterson Farms, Inc. The suit represents all lakefront property owners on Grand Lake O' the Cherokees in northeastern Oklahoma. Plaintiffs are alleging that the companies are causing environmental harm from the discharges and runoffs of wastes from their contract poultry and processing operations. The suit also alleges claims of common law public and private nuisance against the defendants. One of the classes is seeking an injunction against the companies, and the other class is seeking monetary damages due to the reduced value of their properties.
