A class action lawsuit has been filed against the nursing company for allegedly misrepresenting staffing levels and training to elderly residents. The lawsuit, Case #30-200800037875, was filed today in Orange County Superior Court against Sun Mar Health Care, Inc., which promotes itself to people who are elderly and to their families by falsely claiming to provide superior and attentive skilled nursing care. The class action alleges it was Sun Mar's corporate strategy to impose budget guidelines that forced supervisors to understaff facilities and skimp on employee training, all while representing high staffing and training levels to new customers.
The lawsuit seeks to represent all residents who lived in Sun Mar facilities between Jan. 8, 2005, through Jan. 5, 2008. Sun Mar operates 18 nursing homes in California, including six in Orange County and at least eight in the Los Angeles area. It claims Sun Mar misrepresents the quality and nature of the services it provides to residents in order to entice them to pay good money for services it does not provide.
