St. Thomas Development Inc. et al.
A $49 million dollar class action lawsuit has been filed against quarry developer St. Thomas Development Inc. and its managers on behalf of the 5,860 residents of St. Thomas Township in Pennsylvania. The suit alleges that the defendants are violating the resident's fundamental constitutional right to self-government, due process and free speech by essentially trying to nullify newly elected Supervisor Frank Stearn's election. The suit claims that the defendants sent a letter to St. Thomas Township supervisors stating that Stearn should not be allowed to vote on matters involving the developer's proposed quarry and concrete and asphalt plants, and that they might initiate legal action against the township he did vote, which the class action suit claims is unconstitutional.
