A class action lawsuit has been filed alleging unpaid overtime to employees. The lawsuit was filed in San Diego Superior Court alleging Sharp HealthCare nurses are not being paid for lost meal, breaks, and overtime. The case claims Sharp is unwilling to adequately staff its hospitals and refuses to work collaboratively with its nurses to tackle this problem. The lawsuit alleges Sharp coerced registered nurses into not reporting all hours they worked by disciplining the registered nurses who reported overtime and working through their meal and rest periods.
California State law requires employers to give virtually all working people who get paid by the hour, including nurses, meal periods and breaks during their workdays. The law also requires overtime pay for workers who work longer than their normal shift.
