A lawsuit has been filed and is seeking class action status against the home care service company for allegedly failing to pay employees for travel time on the job. The lawsuit was filed in federal court in Georgia on behalf of current and former employees who were not paid for travel time between job sites. The suit also claims that employees who worked for ResCare since 2004 were not paid overtime.
The workers claim ResCare and its Southern Home Care Services Inc. subsidiary violated the Fair Labor Standards Act in the way it compensates workers who provide in-home care for the companies' clients. The lawsuit claims ResCare has a policy of not compensating employees for travel time between job sites that they believe violates labor laws.
