A nationwide certified class action entitled Hypertouch v. Perry Johnson, Inc., San Mateo Superior Court Case No. 418600 is pending against Perry Johnson, Inc., a Michigan corporation, for repeatedly violating the Telephone Consumer Protection Act ("TCPA") by sending unsolicited advertisements by facsimile, commonly known as "junk faxes" to hundreds of thousands of individuals and/or entities nationwide.
The initial faxes usually referred to ISO 9000 training offered by Perry Johnson and offered the recipient the opportunity to have a sales representative come to them and explain the benefits of Perry Johnson's program. Later faxes often identitied themselves as "INFOFAX" in their attempt to avoid liability under the TCPA. A preliminary injunction has been in place since July 30, 2003 which prevents Perry Johnson, Inc. from sending further unsolicited facsimile advertisements.
This action has been filed in San Mateo County in California and the class representative is Hypertouch, Inc. a California business which provides internet services and develops haptic peripherals.
Class members may reside anywhere in the United States. Statutory damages of $500.00 and/or $1,500.00 per occurence are available for each violation.
Class members must give notice in writing on form below by January 17, 2005.
