A class action lawsuit has been filed against the beverage company and a Georgia business association alleging racial discrimination of convenience store owners. The lawsuit claims the Atlanta Retailers Association offers case discounts and display rebates strictly to foreigners. The class action was filed in Fulton County Superior Court and claims the purpose of the discounts and rebates is to permit Pepsi to make inroads in the Indian, Pakistani and Muslim communities.
The lawsuit claims Pepsi is violating a law which governs contracts and states in part that all persons shall have the same right in every State and Territory to make and enforce contracts to the full and equal benefit of all laws. The Pepsi contract appears to be a proxy for racial discrimination.
