Sherman, TX: A federal class action lawsuit has been filed against a chain of tanning salons over allegations that employees were not paid overtime wages, which is in violation of the Fair Labor Standards Act.
Kristin Bennington, lead plaintiff in the proposed action, filed the suit against Palm Beach Tan Inc. She was employed as an assistant store manager and manager, and alleges that during her employment as such the defendant paid herself and other employees a salary to avoid paying overtime.
She alleges that her job duties constituted a small percentage of her managerial duties, and that she spent the bulk of her time cleaning the tanning beds, assisting customers, stocking merchandise and operating the cash register. Therefore, her suit claims, the positions are misclassified as exempt from the overtime requirements of the Fair Labor Standards Act.
Palm Beach Tan has locations throughout the United States, including California, Nevada, and Ohio.
