FT. Lauderdale, FL: A potential class action lawsuit has been filed against American Federation of State, County and Municipal Employees, AFL-CIO, and Josephine Lebeau ("the Defendants") by an employee of the defendants, Larry Johnson and other similarly situated employees of the defendants for overtime compensation and other relief under the Fair Labor Standards Act , as amended (the "FLSA" or the "Act"), 29 U.S.C. §201 et.~.seq.
Specifically, the suit alleges that Larry Johnson's typical weekly schedule, which was sometimes longer, included five (5) days per week, oftentimes six (6), for an understated average of approximately fifty (50) hours per work week. Additionally, the Plaintiff was required to work through his lunch time. He was paid a set amount bi-weekly regardless of the number of hours he worked, and he was never paid at an overtime rate.
The additional persons who may become Plaintiffs in this action are the Defendants' non-exempt employees who have worked in excess of Forty (40) hours during one or more work weeks on or after February 2007 and did not receive time and one-half of their regular rate of pay for all of the hours they worked over Forty (40) in one or more work weeks.
