A class action lawsuit has been filed against the Oceanview Manor Home for Adults of Coney Island on behalf of the home's176 residents, the majority of whom have mental disabilities and receive Supplemental Security Income. The suit alleges that as a form of behavior control, the home has been illegally denying the residents the use of the $127 they receive from the state each month as a personal allowance if the residents fail to take part in certain voluntary programs or shower or bathe. The suit alleges that this practice is in violation of the Americans With Disabilities Act, the federal Rehabilitation Act and state and local anti-discrimination laws.
