A class action lawsuit has been filed on behalf of children with Down syndrome claiming the state department has failed to motivate school districts throughout the state to include such children in mainstream classes. The amended lawsuit was filed in US District Court in Newark and seeks to get permanent placement for children with Down syndrome in regular classes. New Jersey has the highest rate of special education students in outside schools, and is among the lowest rates of those in general education classrooms for the bulk of the school day.
