A complaint has been filed against U.S. Tire Recovery, a company that stored approximately 50,000 tires in a Nitro warehouse that burned and Chemvalley Properties Inc., the owner of the warehouse. The proceeding is seeking class action status. The complaint alleges that the amount of tires stored in the warehouse posed a danger to Nitro residents due to the risk of toxic fumes and vapors if the tires caught fire. The fire allegedly caused the loss of use and enjoyment of property, loss of property value, inconvenience and emotional distress.
