Class action status is being sought in a negligence lawsuit filed against, the State of New Jersey, several private dam owners and their engineers, and the municipalities of Medford Lakes, Medford Township, Tabernacle and Evesham. The suit was filed on behalf of Lumberton property owners who suffered damages from flooding which occurred on July l2, 2004 after several private dams broke, sending torrents of water down the Rancocas Creek. The suit alleges that the dams and their classifications violated the state Safe Dam Act due to improper construction, inspection, maintenance and repair.
