National Money Mart Company, Cash Money Cheque Cashing Inc. and Unicash Franchising Inc.
Three class action lawsuits have been filed against the National Money Mart Company, Cash Money Cheque Cashing Inc. and Unicash Franchising Inc., which operates as Unicash Financial Centres. The suits were filed on behalf of the 'payday lender' customers and allege that the companies charge criminal rates of interest on short-term loans given to gainfully employed consumers. According to the complaint, if the customer repays the loan by the due date, the borrower's next pay day, the interest charged is a legal rate of slightly less than 60% per annum. However, if the borrower misses the due date, additional interest, a "cheque cashing fee" and a "late charge" are charged which the suit claims is in violation of interest rate provisions of the Criminal Code. The class in the suit includes all Canadian customers of the companies, excluding Money Mart customers in Quebec and British Columbia.
