Class action status is being sought in a lawsuit filed against the State of Massachusetts in regards to the low rate of pay to lawyers who represent children and the poor in court. The suit alleges that there is a ''critical and growing shortage of willing, qualified and experienced attorneys'' in many parts of the state, which has led to children and poor people not always getting representation when they need it.
The suit further alleges that the state constitution and state law guarantee ''meaningful and effective'' representation for criminal defendants, juvenile delinquents, children and parents in care and protection proceedings and people in mental health proceedings, and that the low rate of pay is causing attorneys to stop taking assigned cases or to reduce the number of cases they handle. ''Today, Massachusetts ranks near the bottom nationally in the rates of compensation it pays to those attorneys who are assigned or appointed to represent children and indigent adults.''
