Santa Clara, CA: Kohl's is facing a allegations of consumer fraud over fraudulent sales prices. Attorneys for the City of Los Angeles allege the retailer engages in "false reference pricing" by advertising that their merchandise previously sold at higher "original," "regular," or "list" prices in order to to persuade customers to purchase the merchandise at an allegedly reduced "sale" price.
According to California law, retailers cannot advertise an alleged former price of an item unless the old price was the prevailing market price within three months of the advertisement, or unless the date when the price was in effect is clearly stated on the advertisement.
In the lawsuit, Kohl's allegedly sold belted cargo shorts for $35.99, which the retailer claimed was a 40 percent discount from its "original" price of $60. The lawsuit asserts the shorts were never sold for more than $35.99.

I shop at Kohl's regularly, but always question their "reduced" prices. You can often find the same designer/style at Macy's or other stores for the same "reduced" price. There is never a better price at Kohl's in comparison to other stores.
