Santa Clara, CA: J.C. Penney is facing allegations of consumer fraud over fraudulent sales prices. Attorneys for the City of Los Angeles allege the retailer engages in "false reference pricing" by advertising that their merchandise previously sold at higher "original," "regular," or "list" prices in order to to persuade customers to purchase the merchandise at an allegedly reduced "sale" price.
According to California law, retailers cannot advertise an alleged former price of an item unless the old price was the prevailing market price within three months of the advertisement, or unless the date when the price was in effect is clearly stated on the advertisement.
In the lawsuit, in February, J.C. Penney began selling a top for a maternity bathing suit online for a “sale” price of $31.99. It was subsequently marked down to $21.99 and then $14.99. The original price was listed as $46, but the top never sold for that amount. The highest price it ever sold for was $31.99.

I purchased boots at Penny's for 29.99 that were suppose to have been 100$ originally, they had an extraordinary amount of the boots in, and while a good brand they weren't 100$ quality. I would like to join the law suit.

I went to JCpenny's in Los Banos, Merced, and Fresno, CA during Christmas for some diamond earing and all of the stores had excuse. Los Banos store stated they never received them. Fresno store said they were still waiting for shipment and Merced didn't know what I was talking about. so did they even have the earrings o was it a way to get you to the score and false advertise?

I have been a J C Penny's clearance shopper for a long time. I also have discovered sale prices that have confused me after the purchase. I only can afford to shop sales and am very frustrated that this well known store would do this to consumers.
